Please read carefully. These Terms form a binding agreement between you and SHIELD Psychiatry PLLC.

1) Acceptance of Terms

By accessing this website or receiving clinical services from SHIELD Psychiatry PLLC (“SHIELD,” “we,” “us”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not use the site or our services.

2) Scope of Services

We provide pediatric and young-adult telepsychiatry, including psychiatric evaluations, medication management, psychotherapy, CBT-I for insomnia, parent coaching, school collaboration, and related concierge services for patients typically ages 5–25 within Florida.

3) Eligibility & Location

  • Patients must be physically located in the State of Florida at the time of each telehealth visit.
  • For minors, a parent or legal guardian must provide consent and, when clinically indicated, attend the session.
  • You agree to truthfully disclose your current location and identity at each visit.

4) Parental / Guardian Responsibilities (Minors)

  • Provide consent for care, review treatment plans, and participate in safety planning.
  • Ensure a private, distraction-reduced setting suitable for a child’s telehealth visit.
  • Support medication storage, monitoring, and adherence when applicable.
  • Coordinate with schools and other providers when requested to optimize outcomes.

5) No Emergency or Crisis Care

SHIELD does not provide emergency services and does not continuously monitor messages or visit requests. If you or your child are in crisis or at risk of harm, call 911 or 988, go to the nearest emergency department, or contact local crisis services immediately.

6) Telehealth Risks & Technology Requirements

Telehealth depends on third-party platforms, internet connectivity, and device security. Although we use HIPAA-compliant systems and reasonable safeguards, interruptions, delays, unauthorized access, or data loss may occur. You are responsible for:

  • Using a reliable connection and updated devices/software;
  • Participating from a private, quiet space;
  • Not recording sessions without written permission.

7) Informed Consent

Before treatment begins, patients (or guardians for minors) must sign informed consent acknowledging benefits, risks, alternatives, and limitations of telehealth and psychiatric care. You may withdraw consent at any time; however, withdrawal may affect our ability to provide services.

8) Scheduling, Cancellations & Communications

  • Appointments are scheduled through our designated portal. Messages are answered during business hours.
  • Please review our Practice Policies for cancellation/no-show rules and refill timelines.
  • Email or text may be used for coordination and reminders; these channels may not be fully secure. Limit sensitive details to the patient portal.

9) Payment, Billing & Insurance

SHIELD operates on a cash-pay model unless expressly stated otherwise. Fees are due at booking or service. We may provide a superbill for potential out-of-network reimbursement; insurance coverage is not guaranteed. You are responsible for all charges, including late cancellations, no-shows, and non-covered services as described in our Practice Policies.

10) Medical Records, Data Retention & Access

Records are maintained in a HIPAA-compliant electronic health record for the legally required retention period. You may request copies or disclosures as permitted by law. Keep your contact and pharmacy information current.

11) Intellectual Property

All content on this site—including text, graphics, PDFs, videos, and logos—is owned by SHIELD or its licensors and protected by law. You may not copy, distribute, or create derivative works without prior written permission.

12) Third-Party Services & Links

We may use third-party vendors (e.g., scheduling, telehealth, payments). Your use of those services may be subject to their terms and privacy policies. SHIELD is not responsible for third-party websites or platforms.

13) Prohibited Conduct

  • Misrepresenting identity, location, or age;
  • Harassment, abuse, or disruptive behavior toward staff;
  • Attempting to obtain controlled substances improperly;
  • Interfering with or reverse-engineering the website or systems.

14) Disclaimer of Warranties

The site is provided “as is” and “as available.” To the fullest extent permitted by law, SHIELD disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

15) Limitation of Liability

To the maximum extent allowed by law, SHIELD is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site, third-party platforms, or inability to access services. Nothing in these Terms limits liability where prohibited by law.

16) Indemnification

You agree to indemnify and hold harmless SHIELD and its clinicians, employees, and agents from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or misuse of the site or services.

18) Governing Law & Venue

These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-laws rules. Venue for any dispute shall be in the appropriate state or federal courts located in Florida.

19) Changes to Terms

We may update these Terms at any time. Changes take effect upon posting to this page with a new effective date. Continued use constitutes acceptance.
